The two-policy problem

Sydney has proportionally more strata title housing than any other Australian capital, and strata is the arrangement in which a single water event most reliably becomes two separate insurance claims.

The split is not about geography. It is about what failed and where:

Lodge on the same day the strata manager does. The two claims are assessed by different people at different speeds and the one lodged later ends up waiting for the other. It is the single most common reason a Sydney apartment water claim takes months rather than weeks, and it costs nothing to avoid.

Two practical consequences. First, the drying is nearly always your problem to start, whoever ends up paying — a restoration company can extract water from inside your lot on the day, while the question of whose pipe it was is still open. Second, keep the plumber’s identification of the failed component. In a house it decides whether reg 19(1)(a)(vi) or reg 19(2)(b) applies. In a strata building it decides that and which of two policies responds.

New South Wales: the $20,000 line

Home Building Compensation (HBC) cover, formerly called home warranty insurance. It has to be in place before the builder starts and before they take any money, deposit included. NSW publishes a free HBC Check tool so you can confirm a job is covered.

Reinstatement after a water event — new plasterboard, new cabinetry, new flooring, repainting — is home building work. In New South Wales the contractor needs Home Building Compensation cover for any project over over $20,000 including GST, and the cover has to be in place before the work starts and before they take any money, deposit included.

What makes New South Wales unusual is the verification. The state publishes a free register, HBC Check, where anyone can confirm that a job has valid cover. That is a public dataset about a specific contractor and a specific job, and it takes about a minute to use. New South Wales publishes a free register of jobs that have Home Building Compensation cover, so before you pay a deposit on reinstatement over the threshold you can confirm the cover exists.

The threshold cuts both ways. A $14,000 reinstatement in Sydney has no statutory scheme behind it. The same work in Brisbane, where the threshold is more than $3,300 including materials, labour and GST, is covered. If the job is close to the line, it is worth knowing which side of it you are on before you pay a deposit.

Who turns up, and who does not

The distinction matters at 2am. A storm-damaged roof with water coming through a ceiling is an SES job — they will tarp it. A burst flexible hose under a kitchen sink is not; it is a plumber and then a restoration company. Calling the wrong one costs hours that the contamination category does not give back.

And neither of them dries the building. The SES makes it safe, the plumber stops the water, and a third trade does the extraction and the drying. Three separate calls, and in a strata building a fourth to the strata manager.

Apartment-specific problems

Sydney’s stock creates drying problems that a freestanding house does not have:

  • Nowhere for the moisture to go. A sealed apartment with no openable windows on the wet side is a dehumidification problem rather than an air-movement one. Expect more dehumidifier days and fewer air movers than the equivalent floor area in a house — and on the published rate card, dehumidifiers are the expensive unit at $149 per day against $69 for a carpet dryer.
  • Water travels down, and it does not stop at your ceiling. A failure on level 8 can produce claims on 7, 6 and 5. If you are the source, the other owners’ claims are a liability question and your policy’s legal liability section is the part to read.
  • Concrete slabs are Class 4 drying. Water in a slab does not come out on a four-day schedule. A job quoted as a standard dry that turns out to involve slab moisture extends, and every extension is another day of hire.
  • Common-area power and access. Drying equipment runs continuously for days. In an apartment that means somebody’s meter, and in common property it means the owners corporation’s. Settle who is paying for the power before the gear goes in, not after.

Disaster assistance

Where a disaster is declared, Disaster Assist (Australian Government), Disaster Recovery Payment is $1,000 per eligible adult and $400 per child. A one-off, non-means-tested payment, activated for particular declared disasters rather than available on demand. It is not insurance and it does not reduce what an insurer owes you.

It is a Commonwealth payment, not a New South Wales one, and it is activated event by event rather than being available on request. State-level assistance in New South Wales is also activated per event through the joint Commonwealth-state arrangements; this site does not publish New South Wales figures for it, because none were read from a primary source on the build day.

Who pays for water damage in a Sydney strata building?

Usually both policies, on two separate claims. The owners corporation insures the building and common property; you insure what is inside the lot. Reg 33(1)(d) of the Insurance Contracts Regulations 2017 brings a strata title residence inside the prescribed contracts, so the standard cover position is the same for both -- but they are two claims, two excesses and two sets of timeframes.

It depends entirely on what failed and where. A failed pipe inside the upstairs lot is that owner's problem and their insurer's; a failed common-property pipe or a failed waterproofing membrane is the owners corporation's. The plumber's identification of the failed component decides which, which is why getting it in writing on the day matters more here than anywhere else.

How long does a Sydney insurer have to decide?

The same as everywhere else in Australia -- these timeframes are national. Paragraph 77 of the General Insurance Code of Practice sets the outside limit at 4 months from lodgement, stretching to 12 months under paragraph 78 in five listed situations.
